THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT APPEAL No.1376 of 2014 Judgment: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) Learned Advocate for the appellants submits that he does not want to press this appeal, as the Writ Petition was not properly filed. So, he wants to file a proper Writ Petition for the appropriate remedy, as it will suit in the facts and circumstances of the case.
We therefore dismiss the appeal as being withdrawn. However, it would be open for the appellants to file fresh proceedings in accordance with law challenging G.O.Ms.No.66, Social Welfare (SW.EDN.2) Department, dated 08.09.2010, as the same was not challenged in the Writ Petition.
Pending miscellaneous applications, if any, shall also stand closed. No order as to costs.
