Vijayakumar, Advocate for R2) This Criminal Petition is filed under Section 482 of Cr.P.C praying to quash the entire FIR in Crime No.359/2016 dated 30.12.2016 Registered by the Respondent No.1 herein and all consequential proceedings arising there under produced at Annexures-A and B and etc.
This Criminal Petition coming on for Admission this day, the Court made the following:-
O R D E R Petitioners Sri.M.N.Raghu and Sri.M.N.Ravi and their counsel; respondent No.2 Sri.Nagaraju M.D. and his counsel; Addl. SPP for respondent No.1 are present.
2. Petitioners and respondent No.2 have filed a joint memo duly signed by them and their respective counsel.
3. In the memo it is stated that petitioners and respondent No.2 have compromised the dispute in respect of the boundary and agricultural land voluntarily without any coercion and in view of the said compromise, second respondent has agreed to withdraw all the allegations made against the petitioners and seeks permission of this Court to quash the entire proceedings against the petitioners.
4. The charge sheet has been laid against the petitioners for the offences punishable under Sections 504, 323, 506 r/w 34 of IPC.
5. Having regard to the aforesaid settlement between the parties, no purpose would be served in continuing with the prosecution. Hence, in the interest of parties, the joint memo is accepted. Consequently, petition is allowed. Proceedings initiated against the petitioners in Crime No.359/2016 dated 30.12.2016 are hereby quashed.
