JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED : 15.02.2017 CORAM THE HONOURABLE MR. JUSTICE R.MAHADEVAN Crl.O.P.No.3070 of 2017 M.Murugan ... Petitioner Vs The State, rep. by The Sub Inspector of Police, Karimangalam Police Station, Dharmapuri District. ... Respondent Criminal Original Petition filed under Section 482 Cr.P.C. to extend the time to implead the condition imposed in Crl.M.P.No.50 of 2017 dated 9.1.2017 on the file of the learned Principal Sessions Judge at Dharmapuri.
For Petitioner : Mr.H.B.Saravana Kumar For respondent : Mr.C.Emalias, Addl. Public Prosecutor ORDER The present criminal original petition has been filed seeking to extend the time to implead the condition imposed in Crl.M.P.No.50 of 2017 dated 9.1.2017 on the file of the learned Principal Sessions Judge at Dharmapuri.
2. It is the case of the petitioner that seeking anticipatory bail, he approached the learned Principal Sessions Judge at Dharmapuri, by filing a petition in Crl.M.P.No.50 of 2017 and the learned Judge, by order dated 9.1.2017 granted anticipatory bail to the petitioner on certain conditions. One of the conditions is that the petitioner shall surrender before the concerned Court within fifteen days from 9.1.2017. But, due to his illness and family circumstances, the petitioner could not able to surrender before the concerned Court within the stipulated time. Hence, seeking extension of time, the petitioner has come forward with the present petition.
3. However, I am of the opinion that the petitioner can seek remedy before the learned Principal Sessions Judge, Dharmapuri by filing appropriate petition. Hence, the petitioner is permitted to file necessary petition before the learned Principal Sessions Judge at Dharmapuri within a period of two weeks from the date of receipt of a copy of this order and on filing such petition, the same shall be considered by the learned Principal Sessions Judge at Dharmapuri, on merits. The criminal original petition is ordered accordingly.
