ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring that the petitioner is entitiled for relaxation of age by 12 years of service rendered by him under the respondent and consequently direct the respondent to consider the petitioner for the post of LDC/Typist by giving preference over others due to his long experience in the same organization.
Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondent.
It is submitted that the respondent is an autonomous body under the Ministry of Social Justice and Empowerment and it invited applications from the eligible candidates for the post of LDC/Typist at NIMH in unreserved category by Employment Notice No.03/2014. The age limit is below 28 years. The petitioner is Post Graduate in Commerce from Osmania University. He submits that he has been working in the respondent’s institution as LDC/Guest Faculty since September, 2002 till date on temporary basis and put in continuous service of about 12 years.
The learned counsel appearing for the petitioner submits that the selection committee has discretion to relax the age limit. According to the learned counsel the petitioner possessed requisite qualifications and he can be selected for the post of LDC by relaxing his age limit.
In the above circumstances, the respondent is directed to consider the case of the petitioner for appointment of LDC/Typist by using their discretion to relax the age limit, if he is otherwise satisfies the eligibility criteria prescribed under guidelines, within a period of six weeks from the date of receipt of a copy of this order.
Accordingly, the writ petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, filed in this writ petition shall stand closed.
