W.A No.1612 of 2013
M.Maryyayee Ammal ...Appellant Vs
1. The Tamilnadu Electricity Board, Rep. by its Superintendent Engineer, Namakkal Town and District.
2. The Executive Engineer, Tamilnadu Electricity Board, Namakkal Town & District. ...Respondents Prayer:- Writ Appeal filed under clause 15 of the Letter Patent against the order dated 03.12.2012 in W.P.No.28427 of 2011.
For Appellant : No appearance For Respondents : No appearance J U D G M E N T
K.K. SASIDHARAN,J.
The application submitted by the appellant for free electricity connection was rejected by the Executive Engineer, Tamil Nadu Electricity Board, Namakkal. The order was challenged in W.P.No.28427 of 2011. The learned single Judge found that the appellant failed to furnish necessary documents and as such, the authority was correct in rejecting the application for free connection. The said order is under challenge at the instance of the petitioner in W.P.No.28427 of 2011.
2. None appears on behalf of the appellant. There is no representation on behalf of the respondents also.
3. The writ petition filed by the appellant was dismissed by the learned single Judge solely on the ground that necessary documents were not submitted by him for the purpose of giving free electricity connection. The learned single Judge protected the interest of the appellant by making an observation that in case application is made along with necessary documents, the same shall be considered by the respondents. Since the interest of the appellant was protected by the learned single Judge, we do not find any reason to interfere with the said order.
4. We direct the respondents to consider the case of the appellant for giving free electricity connection, in case, application is accompanied with necessary documents.
5. The writ appeal is dismissed with the above observation. No costs.
