ORDER:
This writ petition is filed by the fair shop dealers of shop Nos.3704 and 3705 of Boppapur Village, Yellareddipet Mandal, Siricilla Division of Karimnagar District feeling aggrieved by the Notification bearing No.F/1965/2012, dated 10.10.2014, issued by respondent No.3 for appointment of fair price shop dealer for shop No.3733 of Boppapur Village.
At the hearing, the learned Government Pleader for Civil Supplies, on instructions, submitted that by proceedings bearing No.G4/81/2012, dated 02.03.2012, respondent No.2 has created several new fair price shops and that shop No.3733 is one such shop created on bifurcation of shop No.3705. He has further stated that with respect to shop No.3704 held by petitioner No.1, no bifurcation has been effected and that therefore, the impugned Notification does not in any manner affect his interests.
The learned Government Pleader has also placed before the Court a copy of proceedings bearing No.G4/81/2012, dated 02.03.2012, of respondent No.2, a perusal of which shows that the new fair price shop at Boppapur Village was created by dividing shop No.3705 of Boppapur Village. As petitioner No.1 is not aggrieved by the said action, no order need be passed with regard to his fair price shop. As regards petitioner N.2, he is entitled to file an appeal before the appellate authority as envisaged by G.O.Ms.No.35, dated 17.09.2007.
Subject to the liberty given to petitioner No.2 as above, the writ petition is disposed of.
As a sequel to disposal of the writ petition, W.P.M.P.No.41112 of 2014 shall stand disposed of as infructuous.
