Common Judgment: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) There is a subsequent development by reason of the fact that the Vijayawada Municipal Corporation has refused to regularize the construction made by the appellant and accordingly an order has been passed. We are told that this order is sought to be challenged by the appellants today before the appropriate forum by way of a lunch motion.
We, therefore, close these writ appeals without passing any order and we make it clear that any observation made in these appeals at the interlocutory stage will not stand in the way of taking independent decision by the appropriate forum. In consequence, pending miscellaneous applications shall also stand closed. No costs.
