JUDGMENT / ORDER

1. Mr. Supehia, learned advocate appearing for the petitioner restricts his arguments to prayer B of the prayer clause of the petition which reads as under:
"...
(B) If prayer (A) is not and cannot be granted then the Respondent-Board may be directed to treat the order of penalty as one of termination as stated in the appellate order dated 25.04.2000 and to grant the petitioner all benefits on that basis including pension and gratuity.
