THE HON’BLE SRI JUSTICE R.KANTHA RAO WRIT PETITION NO.22849 OF 2014 ORDER:
Heard the learned counsel appearing for the petitioner and the learned Government Pleader for Panchayat Raj and Rural Development appearing for the respondents.
This writ petition is filed seeking to issue a writ of mandamus, declaring the action of the 3rd respondent in placing the petitioner under suspension by proceedings No.D12/505/SA.TA/2013, dated 6-11-2013 as illegal, arbitrary and violative of principles of natural justice and also violative of Article 14 of the Constitution of India and consequently set aside the said proceedings.
The petitioner is working as Field Assistant in National Rural Employment Guarantee Scheme (NREGS), Kothapally Gram Panchayat, Midgil Mandal, Mahaboobnagar District. He was placed under suspension by an order passed by the 3rd respondent dated 6-11-2013 and enquiry is pending. The allegation against the petitioner seems to be that he resorted to certain financial irregularities.
The learned counsel appearing for the petitioner submits that without sufficient reason, the petitioner was placed under suspension and no enquiry has so far been initiated against the petitioner. The learned counsel seeks to suspend the order of suspension passed by the 3rd respondent.
On the other hand, the learned Government Pleader for Panchayat Raj and Rural Development appearing for the respondents submits that since the enquiry is proposed, the order of suspension cannot be set aside without proceeding with the enquiry.
Having regard to the submissions made by both the learned counsel, the respondents are directed to initiate the enquiry if any and complete the same and pass final orders within a period of four weeks from the date of receipt of a copy of this order.
The writ petition is disposed of accordingly. No order as to costs. The Miscellaneous Petitions pending if any shall stand closed.
