ORDER:
This writ petition is filed with the grievance that respondent No.2 has not been disposing of the appeal filed by the petitioner against order in Rc.No.334/2011(B) dated 11.11.2011 of respondent No.3, whereby he has cancelled the petitioner’s fair price shop authorization.
At the hearing, Mr. N. Ranga Reddy, learned counsel for the petitioner, submitted that pending the appeal before him, respondent No.2 has himself issued show-cause notice to the petitioner on 23.11.2011 to which an explanation has been submitted on 16.04.2012.
In the light of the fact that respondent No.2 himself is holding an enquiry, no purpose will be served by directing him to dispose of the appeal. Instead, respondent No.2 is directed to complete the enquiry, wherein he shall give a fair opportunity of being heard to the petitioner, and pass a final order within one month from the date of receipt of this order.
Subject to the above direction, the writ petition is disposed of.
As a sequel to the disposal of the writ petition, W.P.M.P.No.42166 of 2014 shall stand disposed of as infructuous.
