Order:
This Contempt Case is filed alleging willful disobedience of Order, dated 02-07-2013, in WPMP.No.23008 of 2013 in WP.No.18830 of 2013, by the respondents.
At the hearing, both the respondents are present. In their respective counter-affidavits, they have stated that they have joined their respective offices very recently, much after the Gram Panchayat Elections were conducted. This plea of the respondents has not been disputed by the learned counsel for the petitioner.
Therefore, having regard to the nature of the direction issued by this Court, in respect of which the Contempt is alleged, the respondents, who were not at the helm of the affairs at the relevant time of elections, cannot be proceeded against in this Contempt Case.
The learned Counsel for the petitioner submitted that the learned Government Pleader for Panchayat Raj may co-operate for disposal of the Writ Petition itself, for which the latter has fairly agreed.
In the light of the above facts, the Contempt Case is closed and the respondents are discharged from the contempt proceedings.
