This writ petition is filed with the grievance that on the one hand, respondents 1 to 4 have not been finalizing the proposals initiated vide letter No.DEE/C&B-I/NSRSSP/291, dated 24.10.2014 of the Deputy Executive Engineer, C & B Sub division No.I, NSRS Srisailam Project, for allotment of Acs.51.54 cents of land in favour of Sri Brahmaramba Mallikarjuna District Tribal Rural Development Society, and on the other hand, the officials have not been preventing respondent No.5 from proceeding with the illegal construction over a part of the said land.
The petitioner has averred that representation dated 16.12.2014 has been submitted to various functionaries including respondent No.3 seeking redressal of the grievances and that no action has been taken thereon.
At the hearing, the learned Assistant Government Pleader for Irrigation and Command Area Development (Andhra Pradesh) on instructions, submitted that on coming to know about the alleged illegal constructions being made by respondent No.5, the Irrigation Department is preparing to issue notice to the said respondent and that it will initiate all required measures to prevent illegal constructions of respondent No.5. Inasmuch as the petitioner’s representation submitted to respondent No.3 is stated to be pending, the said respondent is directed to redress the petitioner’s grievance, do the needful and communicate his decision to the petitioner expeditiously.
As regards the grievance against respondent No.5, the submission of the learned Assistant Government Pleader referred to above is placed on record and respondent No.3 is directed to initiate appropriate measures for preventing the illegal constructions, if any made by respondent No.5 after issuing notice to him.
Subject to the above directions, the Writ Petition is disposed of. As a sequel to disposal of main petition, WPMP.No.50981 of 2014 filed by the petitioner for interim relief is disposed of as infructuous.
