ORDER:
This writ petition is filed for the following substantive relief: “…to issue a writ or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the 2nd respondent in not passing the orders on the application for stay or appeal filed by the petitioner on 28.10.2014 against the orders of the 3rd respondent in D.Dis.D1CS/5556/2014 dated 20.10.2014 as illegal, arbitrary and violation of principles of natural justice and consequently direct the 2nd respondent to dispose of appeal filed by the petitioner dated 28.10.2014.”
In obedience to the notice issued by this Court, the incumbent of respondent No.3 is personally present. He has stated that on realizing his mistake in passing the impugned order, he has restored the petitioner’s fair price shop authorization vide proceedings in Rc.D1CS/9003/2014 dated 21.11.2014. He has also submitted to the Court that further action against the petitioner on the charges mentioned in the impugned order is deemed to have been dropped and that he will not proceed with the further enquiry on the said charges.
The above submissions of respondent No.3 are placed on record and the writ petition is disposed of in view of the corrective steps taken by him.
As a sequel to the disposal of the writ petition, W.P.M.P.No.43299 of 2014 shall stand disposed of as infructuous.
