ORDER:
This writ petition is filed for a mandamus to declare the action of respondent Nos.2 to 4 in not allotting and releasing essential commodities to the petitioners’ fair price shops of Tenagal Village, Kundurpi Mandal, Anantapur District without valid reasons as illegal and arbitrary.
By order, dated 22.12.2014, this Court has directed respondent No.4 to be personally present, as this Court prima facie felt that respondent No.4 has engineered two letters, dated 15.09.2014 and 01.11.2014, purportedly written by petitioner Nos.2 and 1 respectively, by fabricating the same. Today, respondent No.4 is personally present. The learned Assistant Government Pleader for Civil Supplies (AP), on instructions, submitted that the incumbent of respondent No.4 who has acted on the above-mentioned two letters submitted in the name of the petitioners has since been transferred and the new incumbent has taken over recently. He has also submitted that the release orders have already been raised in favour of the petitioners for the month of January, 2015 and the essential commodities will be released to the petitioners on the latter submitting the demand drafts.
These submissions of the learned Assistant Government Pleader are placed on record and the writ petition accordingly stands disposed of. As a sequel to disposal of the writ petition, W.P.M.P.No.49171 of 2014 shall stand disposed of as infructuous.
