HON’BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.13888 of 2010 ORDER:
Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for the respondents.
2. The petitioners are the fair price shop dealers of different shops in Dachepalle Mandal, Guntur district. While so, the Station House Officer and his staff, Dachepalle PS, raided the fair price shops of the petitioners on 06.06.2010 and seized 212 bags of rice from the vehicle bearing No.ABK 3047 on transportation from Dachepalli to Naizamabad at Irikepalli X road. As per the statement of the police, 30 bags of PDS rice relating to the first petitioner, 40 bags of PDS rice relating to the 2nd petitioner and 30 bags of PDS rice relating to the 3rd petitioner was involved in the said illegal transportation. The 3rd respondent sent his staff for physical verification of the stock in the presence of the police constables, who noticed no variation in the stock. However, due to pressure from higher officials and local groups, false case was foisted against the petitioners and their authorisations were suspended pending enquiry. Challenging the suspension of the authorisation of all the three petitioners, the present writ petition was filed.
3. The respondents did not file any counter-affidavit. Learned Assistant Government Pleader for the respondents is unable to state whether the enquiry against the petitioners was completed or not. However, this Court by interim order dated 18.06.2010 granted interim suspension of the impugned orders.
4. In the circumstances, the first respondent is directed to complete the enquiry against the petitioners, if it is not already completed, within a period of three months from the date of receipt of a copy of this order and the interim suspension granted by this Court on 18.06.2010 shall continue till the disposal of the enquiry by the 1st respondent.
5. With the above direction, the writ petition is accordingly disposed of. Pending miscellaneous petitions in this writ petition, if any, shall stand dismissed in consequence. No order as to costs.
