RAMACHANDRA REDDY COUNSEL FOR THE RESPONDENT: THE PUBLIC PROSECUTOR Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the memorandum of grounds filed herein, the High Court may be pleased to release the petitioner on anticipatory bail in the event of his arrest in Crime No.156 of 2013 on the file of Khajipet Police Station, Kadapa District.
The Court made the following Order:
“The petitioner is A4. He seeks for grant of anticipatory bail. The petitioner allegedly committed the offences under Section 409 and 420 IPC read with 34 IPC. He was a former Secretary of District Cooperative Central Bank at Khazipet, Kadapa District. He allegedly misappropriated an amount of Rs.6,92,357/-. The learned counsel for the petitioner submitted that surcharge proceedings were issued against the petitioner and that the petitioner paid the money covered by the surcharge proceedings. The petitioner is a retired employee. He is 60 years old. In view of the age of the petitioner and the nature of the offences alleged and also in view of the defence, I consider it appropriate to enlarge the petitioner on anticipatory bail.
Accordingly, this Petition is allowed. The petitioner shall surrender before the learned Additional Judicial Magistrate of First Class, Mydukur, within two weeks from today. On such surrender, the learned Additional Judicial Magistrate of First Class, Mydukur, shall enlarge the petitioner on bail on a bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties in a like sum to his satisfaction.”
