ORDER:
This Contempt Case is filed alleging wilful disobedience of order dated 05.10.2009 in W.A.No.1133 of 2009.
The grievance of the deceased petitioner No.1 is that though the Division Bench of this Court has modified the order of the learned Single Judge by imposing the penalty of stoppage of one increment without future effect, the respondent has not computed notional increments for the period during which the order of dismissal has operated.
Ms. S. Udaya Sri, learned counsel representing Mr. G. Vidyasagar, learned senior counsel for the respondent, submitted that after the case was adjourned last, the respondent has worked out the notional increments and included the same in all the retirement benefits of the petitioner.
Mr. M. Sudheer Kumar, learned counsel for the petitioner, while accepting the submission, however, stated that no order as to payment of differential pay between 02.01.2008, when the employee was reinstated, and 07.12.2012, when he has died, has been made. Ms. S. Udaya Sri, learned counsel, submitted that appropriate order in this regard will be passed and differential pay will be paid to petitioner Nos.2 and 3. This submission of the learned counsel is placed on record.
Inasmuch as the order of the Division Bench of this Court has been fully complied with, the Contempt Case is closed.
