… PETITIONER (By Mr. SYED IMRAN, ADV., FOR R1 TO R3) - - -
… RESPONDENTS This Writ Petition is filed under Articles 226 & 227 of the Constitution of India, praying to quash Annex-L order dated 14-12-2015 passed by the R-2 and direct the respondent to consider the representations of the petitioner’s dated 17-2-2016 at Annexs-N & P and etc.
This Writ Petition coming on for preliminary hearing in ‘B’ group this day, the Court made the following:-
ORDER None for the petitioner.
Sri.Syed Imran, learned counsel for the respondents.
2. In this petition under Articles 226 and 227 of the Constitution of India, the petitioner inter alia seeks a writ of certiorari for quashment of the order dated 14.12.2015, by which the Karnataka State Board of Wakf (hereinafter referred to as ‘the Board’ for short) has constituted the Committee of 21 members for management of the Board for a period of 11 months. The petitioner also seeks a writ of mandamus to the respondents to consider the representations of the petitioner dated 17.02.2016 contained in Annexures-N and P submitted to the respondents and to take action on the aforesaid representations in accordance with law.
3. Learned counsel for the respondents submits that the term of the office bearers of the Board appointed by an order dated 14.12.2015 has come to an end by afflux of time. Therefore, nothing survives for adjudication in this writ petition.
4. I have heard the submissions made by the learned counsel for the respondents and perused the record. From perusal of the order dated 14.12.2015, it is evident that 21 persons were nominated as members of the Managing Committee to manage the affairs of the Board for a period of 11 months. The aforesaid period has already come to an end. Even otherwise, it is not possible to grant any relief in this writ petition as the aforesaid 21 persons are not impleaded as respondents in the writ petition.
For the aforesaid reasons, nothing survives for adjudication in the writ petition and the same is disposed of.
