JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED: 31.7.2017 CORAM
THE HONOURABLE MR.JUSTICE HULUVADI G.RAMESH AND
THE HONOURABLE DR.JUSTICE G.JAYACHANDRAN
C.M.P.No.12440 of 2017 in W.A.SR.No.52100 of 2017 and W.A.SR.No.52100 of 2017 M.C.Krishnan Petitioner/Appellant Vs
1 The Additional Chief Secretary to Government & Chairman of All State Transport Undertakings Government of Tamil Nadu, Fort St. George Chennai-600 009.
2 G.Ravichandran .
3 Metropolitan Transport Corporation (Chennai) Ltd.
No.1 Pallavan Salai Chennai. Represented by its Senior Deputy Manager (Personnel) Respondents/Respondents Prayer: Petition filed under Section 5 of the Limitation Act to condone the delay of 8 days in filing of WA.SR.No.52100 of 2017 and Writ Appeal filed filed under Clause 15 of the Letters Patent against the order dated 5.6.2017 passed in W.P.No.13407 of 2016 on the file of this court.
For petitioner/appellant : Mr.E.Mohamed Abbas For R1 : Mr.V.Jayaprakash Narayanan Special Government Pleader For R3 : Mr.Paramasivadoss COMMON JUDGMENT (Judgment of the court was made by HULUVADI G.RAMESH, J.) Heard the learned counsel appearing for the petitioner/appellant and the learned counsel who take notice on behalf of the respective respondents.
2. Of course, on the aspect of delay of 8 days in filing the writ appeal, though it can be considered, when we took up the matter for consideration on merits, we find that there is an order passed by the learned Single Judge regarding the issues raised, against which, the present appeal is preferred by the petitioner/appellant, who is none but, a Conductor in the Tamil Nadu State Transport Corporation Limited under the control of the respondents.
3. In our view, the petitioner/appellant has no locus standi at all to challenge the validity of selection of Assistant Manager, either in his personal capacity or in the capacity of General Secretary of Law Foundation India Labour Trade Union. Therefore, we do not find any scope for interference with the order of the learned Single Judge since the case of the petitioner/appellant is an abuse of process. Therefore, the petition seeking to condone the delay is dismissed. Consequently, the writ appeal at SR stage is rejected. No costs.
