JUDGMENT / ORDER

Petition under Section 438 of Cr.P.C. praying that in the circumstances stated in the memo of grounds filed herein, the High Court may be pleased to enlarge the Petitioners on bail in the event of their arrest in Crime No. 276 of 2011, before W.P.S., C.C.S., Hyderabad.
The petition coming on for hearing, upon perusing the Petition and the Memo of Grounds filed herein, and upon hearing the arguments of Sri B. Santosh Singh, Advocate for the Petitioners and of the Public Prosecutor on behalf of respondent-State, the Court made the following
ORDER :-
“Petitioners are A2 to A5. They seek for grant of anticipatory bail. They allegedly committed matrimonial offences. The offences are triable by a Magistrate of First Class. It would be appropriate for the petitioners to surrender before the trial Court and move the trial Court for grant of regular bail. However, the second petitioner-A3 is a lady. In view of the sex of the second petitioner, I consider it appropriate to enlarge the second petitioner-A3 on anticipatory bail.
Consequently, this Criminal Petition is allowed so far as the second petitioner-A3 is concerned. The second petitioner- A3 shall surrender before the learned XIII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, within two weeks from today. On such surrender, the learned XIII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad shall enlarge the second petitioner-A3 on bail on a personal bond of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties in a likesum to his satisfaction.
So far as the petitioners 1, 3 and 4 are concerned, this Criminal Petition is disposed of giving liberty to the petitioners to surrender before the trial Court and move the trial Court for grant of regular bail. In such an event, the Trial Court shall consider such an application on merits, without being influenced by any part of this order, and shall dispose of the same on the same day on which it is filed.”
