Order:
The grievance of the petitioner, who claims to be a card holder attached to fair price shop No.32 of Sunkareddipalli Village, Madakasira Mandal, Anantapuram District, is that on the strength of the observations made by this Court in Order, dated 16- 09-2014, in WP.No.27332 of 2014, to the effect that as respondent No.5 has stated that her authorization is in force without being suspended, the official respondents shall supply essential commodities to her as long as her fair price shop authorization is valid and subsisting, respondent Nos.3 and 4 have been proposing to allot essential commodities to the fair price shop being run by respondent No.5 despite the fact that her authorization was suspended on 13-08-2014.
The above-mentioned order passed in WP.No.27332 of 2014 shows that, while taking note of the stand of the Counsel for respondent No.5 that her authorization was not suspended and that the same was subsisting, this Court has directed the official respondents to supply essential commodities to her so long as her fair price shop authorization is valid and subsisting. This Court also left the official respondents free to take appropriate action, if respondent No.5 has committed any violation.
Learned Assistant Government Pleader for Civil Supplies has not disputed the plea of the petitioner that the authorization of respondent No.5 was suspended on 13.08.2014 itself. If that be so, respondent No.5 is not entitled to the supply of essential commodities as per Order, dated 16.09.2014, in WP.No.27332 of 2014, unless the suspension order, stated to have been passed on 13-08-2014, was, subsequently, stayed by this Court or any other forum.
Subject to these observations, the Writ Petition is disposed of.
As a sequel, WPMP.No.42130 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
