This Criminal Original Petition has been filed to direct the Judicial Magistrate No.5, Coimbatore, to complete the criminal proceedings in Crl.M.P.No.4376 of 2012 in C.C. (not numbered) of 2012, within a reasonable time.
2. The learned counsel for the petitioner submitted that the petitioner has filed a private complaint against the respondents for the offences punishable under Section 190(a) r/w 200 Cr.PC before the Trial Court, alleging that on 06.11.2011, the respondents 1 and 2 along with police party, threatened him to give 20 sovereigns of gold jewels to the police, during his detention in the prison. But the said complaint has not been taken up by the Trial Court for disposal. Hence, the counsel seeks a direction to the Trial Court to complete the proceedings in the above case, within a stipulated time frame.
3. Mr.C.Emalias, learned Additional Public Prosecutor, takes notice for the respondents.
4. Considering the facts and circumstances of the case, and also the fact that the case pertains to the year 2012, the learned Judicial Magistrate No.5, Coimbatore is directed to complete the proceedings in Crl.M.P.No.4376 of 2012 in unnumbered C.C.of 2012, within a period of four months from the date of receipt of a copy of this order.
5. The Criminal Original Petition is disposed of accordingly.
