This criminal petition is filed under Section 482 of the Code of Criminal Procedure to quash the entire proceedings in Crime No.110 of 2013 on the file of the Police Station, Shalibanda, Hyderabad District.
Heard the learned counsel appearing for the petitioners, respondent No.2 and the learned Additional Public Prosecutor representing the State/first respondent.
Basing on the report lodged by the second respondent/de facto complainant, the SHO, Shalibanda Police Station registered a case against the petitioners in Crime No.110 of 2013 for the offence punishable under Section 354 of IPC.
Subsequently, the de facto complainant and the petitioners entered into compromise due to intervention of family members, elders and well- wishers and amicably settled the matter outside the Court. The de facto complainant and the petitioners are present in the Court and stated that in view of the compromise the proceedings can be quashed as they are no longer interested to prosecute the case.
As the parties entered into compromise, if the trial is proceeded with, it would not serve any purpose except causing undue hardship and inconvenience to the parties. Therefore, the entire proceedings can be quashed against the petitioners.
Consequently, in exercise of powers under Section 482 of Cr.P.C. the entire proceedings in Crime No.110 of 2013 on the file of the Police Station, Shalibanda, Hyderabad District are hereby quashed against the petitioners and the criminal petition is allowed. The miscellaneous petitions, if any, filed in this criminal petition shall stand closed.
