ORDER:
Petitioners question the impugned notice dated 04.09.2014 under which survey is proposed to be conducted with regard to land in Sy.No.28/4 admeasuring Ac.0.95 cents of Kandukur village.
2. At the instance of the petitioners, this Court had already considered and disposed of WP.No.20805 of 2014 by order dated 04.08.2014. Para 4 of the order in the said writ petition, which is extracted hereunder, already directs the Tahsildar/third respondent to issue prior notice to petitioners and all other adjacent landlords, if survey is proposed:
"4 . Since it is evident that the survey and measurement alone is contemplated and no action for eviction contrary to the decree aforesaid is contemplated, no further orders are necessary. However, respondent No.3 shall issue prior notice to the petitioners and all other adjacent landlords, if he proposes to conduct survey and thereafter conduct the survey in accordance with law.”
3. Learned counsel for the petitioners states that the petitioners had already filed objections on 13.03.2008 against the orders of the Tahsildar dated 11.02.2008. That issue will, however, be considered after the survey report is received.
The writ petition is, therefore, disposed of directing the third respondent to comply with the direction in the para extracted above and conduct survey. As a sequel, miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
