JUDGMENT / ORDER

HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY WRIT PETITION No.31456 of 2014 Date:20.10.2014 Between:
M.A.Waheed, S/o M.A.Karim . Petitioner And:
Telangana State Southern Power Distribution Co. Ltd., reptd by its Chairman and Managing Director and six others.
. Respondents Counsel for the Petitioner: Sri M.Narsimloo Counsel for the Respondents: ---
The Court made the following:
ORDER:
This Writ Petition is filed for a Mandamus to declare the action of the respondents in assessing an amount of Rs.96,459/- against the petitioner’s Service Connection No.821000317/Cat.I, vide assessment order No.DPE/RRS/SDO1/4593/10, dated 29.11.2010, as illegal and arbitrary.
At the hearing, Sri M.Narsimloo, learned counsel for the petitioner, has not disputed that under Section 42(5) of the Electricity Act, 2003, (for short ‘the Act’), a consumer aggrieved by the action of the licensee is entitled to seek redressal of his grievance before the Consumer Grievance Redressal Forum and that a further remedy by way of approaching the Ombudsman under Section 42(6) of the Act is also available.
In view of availability of these remedies, I am inclined to entertain the Writ Petition for adjudication on merits.
The Writ Petition is, accordingly, disposed of with liberty to the petitioner to avail the above-noted remedies. As a sequel to disposal of the Writ Petition, W.P.M.P.No.39323 of 2014 filed by the petitioner for interim relief stands disposed of as infructuous.
