The Court made the following:
ORDER:
This Writ Petition is filed for a Mandamus to declare the action of the respondents, in raising a back bill for a sum of Rs.1,65,795/- in respect of the petitioner’s Service Connection No.821000339/Category-
V (Agriculture) under assessment order No.DPE/RRS/SDO1/4683/11, dated 27.11.2010, as illegal and arbitrary.
At the hearing, Sri M.Narsimloo, learned counsel for the petitioner, has not disputed that under Section 42(5) of the Electricity Act, 2003, a consumer aggrieved by the action of the licensee is entitled to seek redressal of his grievance before the Consumer Grievance Redressal Forum and that a further remedy by way of approaching the Ombudsman under Section 42(6) of the Act is also available.
In view of availability of these remedies, I am not inclined to entertain this Writ Petition for adjudication on merits.
The Writ Petition is, accordingly, disposed of with liberty to the petitioner to avail the above-noted remedies. As a sequel to disposal of the Writ Petition, W.P.M.P.No.39295 of 2014 filed by the petitioner for interim relief stands disposed of as infructuous.
