ORDER:
This Writ Petition is filed for a Mandamus to set aside the provisional assessment notice in Case No.DPE/RRS/SDO1/ 4593/10, dated 29.11.2010, issued for Rs.96,459/- in respect of Service Connection No.821000317/Cat.I.
At the hearing, it has come out that the petitioner has paid 50% of the provisional assessment amount besides the compounding fee of Rs.12,000/-.
In view of these payments, the respondents are directed to restore the power supply to the petitioner’s Service Connection. Respondent No.5 is also directed to refer the dispute relating to the petitioner’s civil liability to the Special Court within two months from the date of receipt of a copy of this order. He is further directed not to disconnect the power supply to the petitioner’s Service Connection for non-payment of the balance 50% of the provisional assessment amount till his civil liability is adjudicated by the Special Court.
Subject to the above directions, the Writ Petition is disposed of.
As a sequel to disposal of the Writ Petition, WPMP.No.51186 of 2014 filed by the petitioner for interim relief is disposed of as infructuous.
