This is one of the cases, which has become infructuous as nothing can be done by this Court, basing on the statement of the learned counsel for the respondent, as no record is available. Therefore, we make the interim order earlier granted as absolute, as at this time, the respondent should not be allowed to make further demand on the basis of the said interim order. However, the deposit made should not be returned to the petitioner and it should be adjusted towards the full and final satisfaction of the disputed tax. The matter is accordingly closed.
The miscellaneous applications, if any pending, shall also stand closed. No costs.
