Petition under Sections 437 & 439 of CR.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to enlarge the Petitoiner/Accused on bail in Crime NO. 62 of 2014 on the file of P.S. Echoda (Judicial First Class Magistrate, Boath) in the interest of justice The petition coming on for hearing, upon perusing the petition and the grounds filed herein, and upon hearing the arguments of Sri R. Gopi Mohan, Advocate for the Petitioner and of the Public Prosecutor on behalf of respondent-State, the Court made the following ORDER:-
“The petitioner seeks for grant of bail. He allegedly committed offences under the provisions of NDPS Act. 97 grams of Ganja was found in the Scooter of the petitioner.
The learned counsel for the petitioner submitted that owing to differences in the village, the contraband was planted in the Scooter of the petitioner. At any rate, where the Ganja seized was far below the commercial quantity, I consider it appropriate to enlarge the petitioner on bail.
Accordingly, this Criminal Petition is allowed. The petitioner is enlarged on bail on a personal bond of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties in a like sum to the satisfaction of the learned Judicial Magistrate of First Class, Boath.”
