HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.25129 of 2011 ORDER :
The grievance of the petitioner is that for the purpose of road widening of the National Highway No.9, requisition was placed by the National Highway Authority to acquire private land. Accordingly, notices under Section 3-A of the National Highways Act, were issued to acquire the land of the petitioner in Sy.No.349 to an extent of 60 square meters; Sy.No.222 to an extent of 1.5 square meters and Sy.No.350 to an extent of 105.349 square meters in Choutuppal Village and Mandal of Nalgonda District. To the entire land, acquisition procedure was followed and compensation was paid to the petitioner. The grievance of the petitioner is that though the notifications confined to above extent of land and compensation was paid, on field more amount of land sought to be acquired by the National Highway, which is illegal and without competence.
2. The National Highway Authority filed counter-affidavit stating that as per the notification only, the land of the petitioner was taken possession and authority is not contemplating to take possession of any extra land of the petitioner, which was not already notified. The authority shall follow due process of law to acquire any additional land as and when required.
3. Having regard to the said submission, the writ petition is disposed of as no further orders are required. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
