The only grievance of the petitioners in this Writ Petition is that having issued the notice in Roc.No.43/2014, dated 04-07- 2014, requiring them to be present at the Market Yard, Palamaner, on 26-07-2014 at 11.00 A.M., for allotment of vacant plots for carrying on their respective businesses in Vegetables and other fruits, no allotments were made on the said date.
Respondent No.5 filed a counter-affidavit wherein she has inter alia stated that as sufficient number of bidders was not available, open auction could not be conducted on the date fixed for that purpose. She has, however, stated that she is ready to conduct open auction for allotment of 10 shops in Palamaner and 5 shops in V.Kota.
At the hearing Mr.T.Balaji, learned Standing Counsel for respondent No.5- Agricultural Market Committee, submitted that his client will ensure that a fresh date is fixed for holding auction, after taking permission from respondent No.3, and that the auction is completed within one month from today.
The above-submission of the learned Standing Counsel for respondent No.5 is placed on record and the Writ Petition is, accordingly, disposed of.
As a sequel to disposal of the Writ Petition, WPMP.No.39417 of 2014, filed by the petitioners for interim relief, is disposed of as infructuous.
