The solitary grievance of the petitioner appears to be that his partition suit in case no. 226 of 2016 (Laxmi Versus Nand Kumar and others), filed under Section 116 of U.P. Revenue Code, 2006, has remained pending before the respondent no. 2 since 2016.
Referring to the order sheet, it has been submitted that the delay has been caused not by the petitioner but majorly on account of the fact that the matter has not been proceeded by the court.
No useful purpose would be served in keeping the present petition pending or calling for a counter affidavit.
Without entering into merits of this case, this writ petition is disposed of with the observation that in case the petitioner files a copy of this order before the respondent no. 2, the said authority shall proceed to decide the aforesaid case pending before him since 2016 as expeditiously as possible preferably within a period of three months from the date of production of a copy of this order before him, provided the petitioner does not seek any adjournment during that period and shall cooperate.
