Heard learned counsel for the applicant and learned A.G.A. as well as perused the record.
The accused Lucky @ Yogesh Kumar Pandey, S/o Sri Rakesh Pandey, R/o Mohalla Roti Godown, P.S. Kotwali Sitapur, District Sitapur is involved and detained in case crime no. 438 of 2010 under Section 2/3 U.P. Gangster and Anti Social Activities (Prevention) Act, 1986, from P.S. Kotwai Sitapur, District Sitapur and he has applied for bail. The submission of learned counsel for the accused applicant is that in the gang chart as many as four cases have been shown against the accused and in all the cases accused is already on bail. Therefore, he deserves to be released on bail.
Learned A.G.A. opposed the bail application. Considered the submission of learned counsel for the applicant and learned A.G.A. Keeping in view of the totality of the facts and circumstances of the case as well as the fact the accused is already on bail, therefore, without expressing any opinion on the merit of the case accused may be released on bail.
Let the applicant Lucky @ Yogesh Kumar Pandey be released on bail in the aforesaid case crime number on his furnishing a personal bond of two sureties each in the like amount to the satisfaction of the court concerned.
