JUDGMENT / ORDER

(AGA served) … Respondents This Writ Petition is filed under Articles 226 and 227 of the Constitution of India, praying to direct the respondents to transfer Five shares of Late Sri. Sivaprakasha Mudaliar in the name of the Petitioner by virtue of the Will dated 23.09.1940 vide Annexure-A by crediting the accrued value in favour of the petitioner, and etc.
This Petition coming on for Preliminary Hearing this day, the Court made the following:-
ORDER Sri. Ganapathi C. V., learned counsel for Sri.Sanket M. Yenagi, learned counsel for the petitioner.
2. In this petition, petitioner interalia has prayed for the following reliefs:
“a) Issuance of an appropriate writ directing the respondents to transfer Five shares of Late Sri. Shivaprakasha Mudaliar in the name of the petitioner by virtue of the Will dated 23.09.1940 at Annexure-A by crediting the accrued value in favour of the petitioner, in the interest of justice and equity.
b) Passing of such other order/s or directions as this Hon’ble Court deems fit to grant in the circumstance of the case.”
3. When the matter was taken up today, learned counsel for the petitioner submitted that with regard to his grievance, the petitioner has submitted a representation contained in Annexure- B to respondent Nos.1 and 2 and further submitted that the competent authority be directed to consider the representation by a speaking order within a fixed time limit.
4. In view of the aforesaid submission and in the facts of the case, writ petition is disposed of with a direction to respondent Nos.1 and 2 to take an appropriate action in accordance with law by a speaking order within a period of six weeks from the date of receipt of certified copy of the order passed today on the representation, which is pending consideration before respondent Nos.1 and 2.
