Heard learned counsel for the petitioner and learned counsel for the State through Video Conferencing.
Considering the order proposed to be passed issuance of notice to the private opposite parties is dispensed with.
As regards relief No.1, the remaining proceedings for maintenance pending before the Additional Principal Judge, Family Court, Lucknow and raise such objections as may be permissible as to the said proceedings. So far as relief No.2 is concerned petitioner can file his objections before the competent Army Authority, if any proceeding related to his wife i.e. opposite party No.2 is pending before the same. But there is no reason why this Court should consider the reliefs prayed for and interfere in the matter. Moreover, we find that no Army Official has been arrayed as opposite party by designation.
Be that as it may, for the reasons aforesaid, we are not inclined to interfere in the matter and present petition is dismissed, without prejudice to the rights of the petitioner and opposite party No.2 in the pending proceeding.
