JUDGMENT / ORDER

This writ petition has been filed praying for a writ of mandamus to direct the first and the second respondents to consider the petitioner's loan application for an educational loan under "Gyan Jothi Education Loan Scheme" and to grant the loan to the petitioner to complete his M.B.B.S. course in the third respondent College.
2. The petitioner has stated that he is studying M.B.B.S. degree course at Aarupadai Veedu Medical College and Hospital, Pondicherry. He belongs to Christian Adi Dravidar Community. Since he is not in a position to pay the fees, he had approached the first respondent Bank in the month of June, 2008, to avail an educational loan, under the 'Gyan Jothi Education Loan Scheme'. However, the first respondent had not granted the loan, as requested by the petitioner. In such circumstances, the petitioner has preferred the present writ petition before this Court, under Article 226 of the Constitution of India.

Ms.Rita Chandrasekar, the learned counsel appearing on behalf of the first and second respondents had submitted that the educational loan would be sanctioned to the petitioner, if the petitioner had satisfied all the necessary conditions for the granting of the loan. If the petitioner had fulfilled all the requirements, there would not be any hurdle for the first and second respondents to sanction and disburse the loan amount to the third respondent College, as requested by the petitioner.

In view of the submissions made by the learned counsel appearing for the petitioner, as well as the learned counsel appearing for the first and second respondents, the first and second respondents are directed to sanction and disburse the educational loan, as requested by the petitioner under 'Gyan Jothi Education Loan Scheme', subject to the norms, regulations and the rules applicable to the granting of such a loan. On the petitioner complying with the requirements, the first and second respondents are directed to sanction and disburse the loan amounts, in accordance with the procedures established by the law, within a period of four weeks from the date of receipt of a copy of this order.
The writ petition is disposed of with the above directions. No costs.
