This is a petition filed under Section 227 of the Constitution of India, seeking a direction to issue carbon copy of the judgments in AS Nos.51/2014 and 52/2014 pending before the District Court, Pathanamthitta, which are disposed of on 17.10.2014. 2. Petitioners has instituted a suit for permanent prohibitory injunction. The defendants in this suit instituted another suit.
3. The trial court by Ext.P1 judgment decreed the suit filed by the petitioners and dismissed the suit filed by the defendants. The defendant preferred two appeals before the lower appellate court As AS 51/2014 and AS 52/2014. The lower appellate court reversed the judgment and decree in both the suits and dismissed the suit filed by the petitioner, and decreed the suit filed by -2-
O.P.(C). No. 2450 of 2014 the defendants.
4. The grievance of the petitioners is that if the judgment and decree in the suit filed by the respondent is given effect to, irreparable loss and injury will be caused to him. He is not able to pursue further proceedings against the dismissal of the suit since the carbon copy of the judgment has not been obtained.
5. In the result, this petition is disposed of as under:
There will be a direction to the District Court, Pathanamthitta to issue carbon copies of the judgments dated 17.10.2014 in AS Nos.51/2014 and 52/2014 within a period of three weeks from today. Operation of the decree shall be kept in abeyance till then.
