ORDER:
This appeal is filed against Judgment and decree dated 31-3-2006 in O.S.No.955 of 1996 on the file of the learned Senior Civil Judge, Visakhapatnam.
ASMP No.1609 of 2014 has been filed by both the petitioner as well as the respondents, for disposing of the appeal in terms of the compromise entered between them as per partition deed dated 13-8-2014. The parties have filed a photocopy of the partition deed and produced the original unregistered partition deed prepared on a stamp paper.
The appellant, the respondents and/or their General Power of Attorney (GPA) holders are personally present in the Court.
The learned Counsel for both the parties submitted that the parties are going to register the partition deed dated 13-8-2014.
Sri Harinath Reddy Soma, learned Counsel for the appellant and Sri T.D. Phani Kumar, learned Counsel representing the respondents, submitted that their respective clients have voluntarily agreed to enter into compromise and have accordingly executed the partition deed.
In the light of the above facts, ASMP No1609 of 2014 is allowed. The appeal is disposed of based on the compromise entered into between the parties and partition deed dated 13-8-2014.
The Registry shall draft the decree based on partition deed dated 13-8-2014 if the parties produce the registered partition deed within six weeks from today. It is made clear that if the registered partition deed is not produced, this order will stand set-aside and the appeal will stand restored to file.
As a sequel to the disposal of the appeal, interim order dated 13-7-2006 is vacated and ASMP No.1275 of 2006 is disposed of as infructuous.
