Heard Sri Pradeep Kumar, learned counsel for the petitioner, Smt. Rishu Mishra, learned counsel for the Corporation and learned Standing Counsel for the respondent- State.
Present writ petition has been filed by the petitioner Loknath, who is son of Shivpujan, claims to have inherited the property of the deceased Smt. Tirathraji Devi under a will document.
Learned counsel for the respondent- Corporation submits, the electricity connection exists at the aforesaid property inherited by the petitioner. Thus, by demand notice dated 18.06.2021 a sum of Rs.1,44,392/- has been demanded.
Learned counsel for the petitioner has set up a plea that the petitioner is not a registered consumer and therefore, he is not liable to pay the bill as the outstanding bill is in the name of deceased Smt. Tirathraji Devi.
Inasmuch as, it is undisputed that the demand for the period is after the death of Smt. Tirathraji Devi, who is died on 15.09.2003, we are not inclined to interfere in the writ petition under Article 226 of the Constitution of India. Prima faice, it clearly appears that petitioner has consumed electricity for which he has to pay.
Accordingly, The writ petition is dismissed.
If the petitioner denies consumption of electricity, it would open to the petitioner to avail statutory remedy of appeal.
