Heard learned counsel for petitioner and learned A.G.A. as well as perused records.
This petition has been filed by the petitioner with a prayer to quash the entire proceedings of Criminal Case No. 469 of 2017 arising out of case crime no. 07 of 2016 under sections 3 RP(UP) Act P.S. RPF Gajraula district Moradahad State Versus Lokesh and others pending in the court of Additional Chief Judicial Magistrate(Railway) Moradabad After arguing at some length, learned counsel for petitioner submits that he shall be file an application for discharge which may be considered by the Court below.
In view of aforesaid, learned counsel for petitioner is permitted to move discharge application on behalf of petitioner. In case discharge application is moved, the same shall be considered and decided expeditiously by the Court below in accordance with law preferably within two months.
With the aforesaid, the petition is disposed of.
