JUDGMENT / ORDER

Court No. - 74
Case :- CRIMINAL MISC ANTICIPATORY BAIL APPLICATION U/S 438 CR.P.C. No. - 8571 of 2021 Applicant :- Lokesh Sharma And Another Opposite Party :- State of U.P.
Counsel for Applicant :- Shravan Kumar Singh Counsel for Opposite Party :- G.A.,Ishwar Chandra Tyagi
Hon'ble Pradeep Kumar Srivastava,J.
Heard learned counsel for the applicants, learned A.G.A. for the State and perused the record.
This is an application of the anticipatory bail given by the applicants Lokesh Sharma and Roshni Sharma in Case Crime No. 685 of 2020, under Sections 498-A, 323, 324, 307, 308 I.P.C. and Section 3/4 Dowry Prohibition Act, P.S.- Dadari, District Gautam Budh Nagar.
At the very outset, it has been submitted that the applicant no.1 Lokesh Sharma (father-in-law) has already been arrested, therefore, in respect of applicant no.1 anticipatory bail application has become infructuous and the same is rejected.
In favour of the applicant no.2 Roshni Sharma who is mother- in-law and interim protection order was passed on 25.06.2021. The applicant no.2 has been falsely implicated in the present case. There is no specific allegation against the applicant no.2, therefore, it appears that an interim protection given to her vide order dated 25.06.2021 should be extended till filing of charge sheet and accordingly, the application should be disposed of.
An anticipatory bail application is finally disposed of in respect of applicant no.2 extending the protection which was given vide order dated 25.06.2021 till filing of charge sheet.
Order Date :- 30.7.2021 Mini
