Heard learned counsel for the petitioner and Shri M.N. Singh, Advocate appearing for the respondent nos. 1 and 2.
The petitioner, who is the participant in the written examination of Combined Junior Engineer Examination-2013 (Special Recruitment) and the roll no. 4334 is allotted to him. Alternatively, it has also been prayed to issue direction to the respondent authorities to produce the answer books of the said examination before this Court and to get re-examined by an expert of the subject concerned.
Learned counsel for the petitioner precisely submits that he is not pressing the first relief and he is pressing only the second relief.
At the very outset, Shri M.N. Singh, learned counsel appearing for the respondents has fairly stated that in the light of the order of this Court dated 18.11.2019 passed in Service Single No. 31655 of 2019 (Atul Kumar vs. U.P. Public Service Commission, Prayagraj and another), the petitioner would be permitted to inspect the answer books on a given date after finalization of the examination process.
In view of above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally, with observations that in case the petitioner moves an appropriate application for inspection of his answer books after finalization of the said examination then definitely the Commission would redress the grievance of the petitioner in the light of the observations so made by this Court.
