The dispute in the instant matter involves a Bank fraud where money has been fraudulently withdrawn from the bank account of the complainant. The applicants' are Manager and other staff of the Bank whose complicity has been found after investigation by the police. It is a matter of grave consequences as it affects the fidelity of the banking system. In proceedings under Section 482 Cr.P.C. this Court would certainly not interfere with proceedings in a matter of the present kind that affects the banking system.
It is however, made clear that anything said in this order will not prejudice the case of the applicants in any manner and it is for the Trial Court to determine on merits whether the charges against the applicants are established or not.
This application is, accordingly, dismissed.
