JUDGMENT / ORDER

Mr.L.Narayanappa, a resident of Mutthoor village, Sandhanappalli Post, Denkanikottai Taluk has come to this Court seeking issuance of a writ of mandamus, directing the respondents to consider his representation dated 28.12.2016 and issue free electricity service connection for his agriculture land in S.No.1471/7 situated at Sandhanappalli Village, Denkanikottai Taluk, Krishnagiri District.
2. Mr.M.Varunkumar, learned standing counsel takes notice on behalf of the respondents.

Learned counsel for the petitioner submitted that when the petitioner is owning agricultural land in Survey No.1471/7 situated at Sandhanappalli Village, Denkanikottai Taluk, which is also a patta land, he made a representation to the third respondent through registered post on 28.3.2016 requesting him to issue free electricity service connection for his agricultural land. But the third respondent refused to receive the same. As the petitioner is an agricultural farmer eking out his livelihood by cultivating the land, if the electricity service connection is provided, he will be able to comfortably make double crop. Therefore a direction should be issued. He has also brought to the notice of this Court an order dated 22.4.2016 passed in W.P.No.14832 of 2016, wherein a direction was given to the petitioner to file an application before the respondents, which was also directed to be considered by the respondents on merits. Pursuant to the said direction, when he made an application on 29.5.2016, the same was refused to be received. Thereafter, he has sent the application with representation on 28.12.2016 through registered post and the same has been received by the respondents.

The postal seal dated 28.12.2016 clearly shows that the petitioner had sent the application seeking electricity service connection to his agricultural land in Survey No.1471/7 situated at Sandhanappalli Village, Denkanikottai Taluk to the second respondent. Therefore, the second respondent is hereby directed to receive one more copy of the application from the petitioner and consider the same on merits, applying seniority, in accordance with law. The writ petition is disposed of accordingly. No costs.
