Heard learned counsel for the petitioner as well as learned Standing Counsel on behalf of the State Authorities.
The instant writ petition has been filed seeking following reliefs:
"I. To issue a writ, order or direction in the nature of mandamus, commanding and directing the opposite parties to pass necessary orders for relaxation in additional transportation tax, expenses on permit and fitness, in favour of the petitioner.
II. To issue a writ, order or direction in the nature of ad-interim mandamus, commanding and directing the opposite parties to not to adopt any coercive measure against the petitioner, during the pendency of present petition.
III- To issue any other order or direction under the facts and circumstances of the case, which this Hon'ble Court may deems fit, in favour of the to meet the ends of justice."
At the very outset, an objection has been raised by the learned Standing Counsel that the grievance as raised by the petitioner in the instant writ petition cannot be canvassed in the form of public interest litigation . It is submitted that the issue involved in the present writ petition can only relate to an individual person, whereas the society which has instituted the instant writ petition cannot agitate the aforesaid matter.
At this stage, learned counsel for the petitioner submits that he may be permitted to withdraw this writ petition with liberty to file it afresh in individual capacity.
In this view of the matter, writ petition is dismissed as withdrawn with aforesaid liberty.
