Heard Sri Vikas Budhwar learned counsel for the petitioner and Sri Jagannath Maurya learned counsel for the respondent No.2.
The petitioner is an employee of the U.P. State Employees Welfare Corporation and has been sent to another corporation namely U.P. Rajya Khad Ewam Awashakaya Vastu Nitam Limited under a scheme known as "Body Shopping" framed by the State Government vide Government order dated 11.11.1998.
Sri Jagannath Maurya learned counsel for the respondent has brought the minutes of the meeting dated 26.04.2018 held under the Chairmanship of the Chief Secretary, State of U.P. wherein it was decided that 45 employees of the U.P. State Welfare Corporation be sent to the U.P. Rajya Khad Ewam Awashakaya Vastu Nitam Limited under the "Body Shopping" as the said corporation did not agree to take these employees on deputation.
It is submitted by learned counsel for the respondent that the Employees Welfare Corporation is running under loss and for that fact, salary of its employees including the petitioner herein could not be paid for long. In order to address the inconvenience being faced by the employees of the Employees Welfare Corporation, the aforesaid decision has been taken. It is further contended that in case of sending the petitioner to the said Corporation, no prejudice would be caused to him, in as much as, his service conditions, pay and allowances etc. would not change.
In view of the said submission, this Court does not find any justification to interfere. The writ petition is, accordingly, disposed of with the direction that in case of any future grievance, it would be open for the petitioner to approach the competent authority.
