Liyakat Ali vs Rajesh Singh & Others

High Court Of Judicature at Allahabad|11 February, 2021

JUDGMENT / ORDER

Heard.
This petition has been filed with the following main prayer:-
"(A) to set aside the order dated: 09.10.2020 as contained in Annexure no. 1 passed by the opposite party no.7 in Misc Case no. 4-c/2015, Rajesh Singh versus Liyakat Ali and to quash the Recovery Citation as contained in Annexure no.2 issued by the opposite party no.8."
Learned Standing Counsel has informed that the petitioner alleges that he was the owner of the Tempo Taxi Vehicle No. UP 32 Z 7004, which was sold off by him to one Arjun Gupta @ Arvind Gupta in the year 2004. The vehicle met with an accident and thereafter the Claim Petition No.520 of 2005 was filed, wherein an order has been passed by the competent authority on 07.09.2007. The petitioner had not challenged the said order. He is only challenging the consequential proceedings and the petition is not maintainable.
Arguments raised by Sri Krishna Singh, learned Standing Counsel, appear to be correct.
The petitioner will have to challenge the order passed by the Additional District Judge/ Motor Accident Claim Tribunal, Lucknow, even if it is ex parte, before any relief can be granted to him as prayed for.
The petition stands dismissed.
Order Date :- 11.2.2021 Rahul
