The above appeal, pertained to the year 2009, is filed with a delay of 451 days. The appellant is challenging the judgment dated 31.08.2007 by which the marriage between her and the respondent is dissolved under Section 10(1)(x) of the Divorce Act, 1869 at the instance of the respondent herein, who is the husband. Registry has noted the defect and granted time to the appellant to cure the defect. Though, today the case is posted in the defect list, there is no representation. The above approach of the appellant shows that she is not interested in prosecuting the matter. Accordingly, the delay petition and the above appeal is dismissed for non- prosecution.
