Lingala Anantha Kumar @ Abhiram, S/o. Anjaneyulu .. Petitioner (Accused in Cr.No.282/2014 of Pattabipuram P.S., Guntur) AND The State of A.P., rep. by its P.P., High Court of Andhra Pradesh, Hyderabad.
Respondent/Complainant Petition under Sections 437 and 439 of Cr. P.C. praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to enlarge the petitioner on bail in connection with Cr.No. 282/2014 dt. 15-4-2014 of Pattabhipuram Police Station, Guntur.
The Petition coming on for hearing upon perusing the petition and grounds filed herein and upon hearing the arguments of Sri Suresh Kumar Potturi, Advocate for the Petitioner and of the Public Prosecutor for the Respondent, the Court made the following ORDER:
“ Heard both sides.
The petitioner-accused is charged for an offence punishable under Section 498-A, 417, 420 of IPC and Sections 3 and 4 of Dowry Prohibition Act. He seeks for grant of bail.
It is the contention of the petitioner-accused that in between the de facto complainant and himself a love marriage was performed and it is also registered. Subsequently, at the instance of the parents of the de facto complainant, the complainant who is his wife left his company and he was constrained to file a complaint with the police informing about the missing of his wife. Thereafter, the present complaint is said to have been filed. The petitioner-accused has been remanded to judicial custody on 17.04.2014.
In view of the above, I deem it appropriate to enlarge the petitioner-A1 on bail.
Accordingly, this Criminal Petition is allowed and the petitioner is directed to be released on bail subject to the condition of his executing a personal bond for Rs.10,000/- (Rupees Ten Thousand Only) with two sureties in a like sum each to the satisfaction of the learned Special Judicial Magistrate of First Class for Prohibition and Excise, Guntur.”
