Heard learned counsel for the petitioner.
This writ petition has been filed seeking the following relief:-
"(i) Issue, a writ, order, or direction in the nature of mandamus, commanding the respondent no. 3 to decide the representation of petitioner dated 18.04.2019 and deposed of the same within a time bound period as may be fixed by this Hon'ble Court in the interest of justice."
In the representation dated 18.04.2019, the case of the petitioner is that a chak nali is about to be dug up affecting the chak of the petitioner and that the Lekhpal concerned is not interested in getting a valid demarcation carried out.
In my considered opinion, in case the petitioner wants a demarcation of his plot, it is always open for him to file a proper application under Section 24 of the U.P. Revenue Code, 2006. No demarcation, in fact, can be ordered merely on the basis of a representation.
For the same reason, this Court does not consider it expedient to issue any direction for a decision on the representation because the petitioner can always, as observed herein above, file a proper application under Section 24 of the U.P. Revenue Code, 2006 seeking a demarcation.
Subject to the above, this writ petition is dismissed.
